Terms of Use

These Terms of Use form a legally binding agreement governing access to and use of the HVRPAL mobile application for HVAC/R technicians, aspiring technicians, and general users.

Agreement

Effective Date: September 20, 2026

These Terms of Use (the "Terms") form a legally binding agreement between the user ("you" or "your") and HVRPAL (the "App," "HVRPAL," "we," "us," or "our") regarding access to and use of the HVRPAL mobile application.

By accessing or using HVRPAL, creating an account, or subscribing through a mobile platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

1Eligibility and scope

HVRPAL is a mobile application intended primarily for HVAC/R technicians and aspiring technicians. The App may also be used by general users, but all users are responsible for determining whether the App and its content are appropriate for their needs.

You must be at least 13 years old to create an account or use the App. If you are between 13 and 17 years old, you may only use the App with the knowledge and consent of a parent or legal guardian, who is responsible for your compliance with these Terms. By creating an account, you represent that you meet these age requirements.

The App provides access to calculators, manuals, charts, tables, AI-assisted features, and related informational resources. The App is offered as an informational and workflow-support tool only and does not replace professional judgment, technical training, safety procedures, legal compliance review, employer requirements, or manufacturer instructions.

2Account registration and deletion

Use of HVRPAL requires account registration. You agree to provide current, complete, and accurate information during registration and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You must promptly notify HVRPAL of any unauthorized access to or use of your account.

You may permanently delete your account and the personal information associated with it at any time from within the App (Profile, then Delete Account), or by emailing officialhvrpal@gmail.com from your registered email address if you no longer have access to the App. Deletion is handled as described in our Privacy Policy, including the limited circumstances in which certain records may be retained.

3Subscriptions and app store billing

HVRPAL is provided on a subscription basis, currently offered as weekly and monthly plans. Subscriptions are purchased, managed, renewed, canceled, and billed through Apple App Store or Google Play, as applicable.

We use RevenueCat, a third-party subscription management provider, to verify your subscription status and entitlements. RevenueCat's processing of related data is described in our Privacy Policy.

HVRPAL does not directly process your payment card information for subscriptions where billing is handled by Apple or Google. Refunds, cancellations, billing disputes, and renewal settings are subject to the applicable app marketplace's terms and policies.

4Privacy and personal data

Your use of the App is also subject to the HVRPAL Privacy Policy, which is incorporated by reference.

HVRPAL may collect personal information including your name, birthday, profile image, company information, job title, and email address, as described in the Privacy Policy. The App may also use location data solely for app functionality as described in the Privacy Policy.

5User content

The App permits users to upload a profile image and to submit other content in connection with their account, such as job or client records, notes, and prompts or messages submitted through AI-related features ("User Content"). You retain any rights you may have in your User Content, but you grant HVRPAL a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use that content solely as necessary to operate, maintain, and improve the App.

You represent and warrant that you own or have all necessary rights to submit any User Content you provide, and that such content does not violate the rights of any third party or any applicable law. If your User Content includes personal information about a third party (for example, a customer's name or address entered as part of a job record), you represent that you have the right to provide that information to us and that you are responsible for complying with any applicable privacy or data protection laws with respect to that third party's information.

6Prohibited conduct

You agree not to, and not to assist or permit others to:

  • Use the App for unlawful, deceptive, or fraudulent purposes.
  • Harass, threaten, abuse, or harm any person.
  • Upload content that infringes intellectual property, privacy, publicity, or other legal rights.
  • Submit prompts or requests to any AI-related feature intended to generate illegal, harmful, or infringing content, or otherwise misuse those features.
  • Scrape, harvest, copy, or systematically extract App content or data.
  • Reverse engineer, decompile, disassemble, modify, or create derivative works of the App, except to the limited extent such restriction is prohibited by applicable law.
  • Interfere with or disrupt the integrity, security, or performance of the App.
  • Attempt to gain unauthorized access to accounts, systems, or networks connected to the App.
  • Use the App in a manner that could damage HVRPAL, its services, or other users.

7Intellectual property rights

All rights, title, and interest in and to the App, including its software, design, branding, logos, text, graphics, calculators, compilations, and other content, are owned by or licensed to HVRPAL and are protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms and any active subscription requirements, HVRPAL grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the App for its intended internal personal or business-reference use.

8Suspension and termination

HVRPAL reserves the right to suspend, restrict, or terminate your access to the App, with or without notice, if HVRPAL reasonably believes that you have violated these Terms, misused the App (including AI-related features), engaged in abuse or fraud, or created risk or potential legal exposure for HVRPAL or others.

If we reasonably believe your account was used in a way that may involve illegal activity, a safety risk, or a matter appropriate for referral to law enforcement, we may disable your account and retain associated records, including AI-related submissions, for as long as reasonably necessary to investigate the matter, respond to legal process, or support a referral to law enforcement or regulatory authorities, even where you have requested deletion of your account. This is described further in our Privacy Policy.

Termination or suspension may also occur if your subscription expires, is canceled, or is otherwise discontinued through the applicable app marketplace.

9Disclaimers

The App and all content, tools, and materials made available through it — including any AI-generated output — are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, except where such disclaimers are not permitted by law.

Without limiting the foregoing, HVRPAL does not warrant that the App will be uninterrupted, secure, error-free, accurate, complete, reliable, or suitable for every technical, legal, safety, or field-use scenario. AI-related features may produce inaccurate or incomplete responses. You are solely responsible for independently verifying calculations, charts, tables, manuals, AI-generated output, and other information before relying on them in diagnostic, service, installation, compliance, or safety contexts.

10Limitation of liability

To the maximum extent permitted by applicable law, HVRPAL and its owners, operators, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business opportunities, goodwill, data, or business interruption, arising out of or related to your use of or inability to use the App.

To the extent any liability cannot be fully disclaimed, HVRPAL's total liability for claims arising out of or relating to the App will be limited to the amount you paid, if any, for the subscription giving rise to the claim during the twelve months preceding the event giving rise to liability.

11Governing law

These Terms and any dispute arising out of or relating to these Terms or the App shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

12App Store and Google Play acknowledgments

If you downloaded the App from the Apple App Store, the following additional terms apply and you acknowledge and agree that:

  • These Terms are entered into between you and HVRPAL only, and not with Apple. HVRPAL, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to furnish any maintenance or support services for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
  • HVRPAL, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service, and refunds, cancellations, and billing disputes for Google Play purchases are handled by Google.

13Changes to these Terms

HVRPAL may update these Terms from time to time. Continued use of the App after revised Terms become effective constitutes acceptance of the updated Terms, unless applicable law requires additional notice or consent.
